BIDS FOR EARLY COUNTY

ROAD PAVING PROJECT

1.1.01 RECEIPT OF PROPOSALS: Sealed Proposals on forms prepared by Regional Engineering Group, Inc., hereafter referred to as the Engineer, will be received by the Early County Board of Commissioners at the office of the County Administrator located at 17 McDonald Street, Blakely, Georgia 39823 until 2:00 PM (local time) on July 10, 2007, for the construction of:

CDBG ROAD IMPROVEMENTS AND

PAVING OF COUNTY ROADS: CR 198, CRYSTAL SPRINGS LOOP,

CR 305, SUMMERSET LOOP,

AND CR 333, SUNNYSIDE LANE

FOR

EARLY COUNTY

consisting of the grading and paving of approximately 8,815 L.F. of existing ditch section roadway in accordance with Drawings, Specifications and other Contract Documents prepared by Regional Engineering Group, Inc.

1.1.02 PROPOSALS WILL BE PUBLICLY OPENED AND READ at 2:00 PM (local time) on July 10, 2007, at the office of the County Administrator, located at 17 McDonald Street, Blakely, Georgia 39823.

1.1.03 OBTAINING CONTRACT DOCUMENTS: Drawings, Specifications and other Contract Documents may be reviewed at the office of the County Administrator located at 17 McDonald Street, Blakely, Georgia and obtained upon application at the corporate office of Regional Engineering Group, Inc. located at 1504 Third Avenue, Albany, Ga. 31707 after 8:30 AM on June 4, 2007, upon the payment of a deposit of $100.00 per set. One-half of the deposit will be returned to unsuccessful bidders if plans and specifications are returned in a useable condition.

1.1.04 PROPOSAL GUARANTY: A bid bond shall be required in the amount of 5% of the total bid amount.

1.1.05 BONDS REQUIRED: A Contract Performance Bond and a Materials and Payment Bond will be required of the successful bidder.

1.1.06 NO PROPOSALS WITHDRAWN: No submitted proposal may be withdrawn for a period of sixty (60) days after the closing time scheduled for the receipt of bids.

1.1.07 OWNERS RIGHTS RESERVED: The Early County Board of Commissioners, hereinafter called the Owner, reserves the right to reject any or all Proposals and to waive any formality or technicality and to award the Proposal as may be in the best interest of the Owner, or readvertise for bids.

060607-02 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF EARLY

Because of a default in the payment of the indebtedness secured by a Security Deed executed by Barbara Tolbert to New Century Mortgage Corporation dated August 15, 2001, and recorded in Deed Book 239, Page 731, Early County Records, said Security Deed having been last sold, assigned, transferred and conveyed to U.S. Bank, N.A., as Trustee for New Century Home Equity Loan Trust, Series 2001-NC2 Asset Backed Pass-Through Certificates, by Assignment dated January 3, 2006 and recorded in Deed Book 274, Page 199, aforesaid records securing a Note in the original principal amount of $96,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, July 3, 2007, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:

All that tract or parcel of land situate, lying and being in Early County, Georgia and being more particularly described as follows: Beginning at a 5/8 inch iron pipe marking the Southeast intersection of Old Lucille Road and Mays Mill Road, and thence South 89 degrees 05 minutes 08 seconds East along the South right of way margin of Mays Mill Road (a 30 foot right of way) 581.60 feet to a 5/8 inch iron pipe; thence South 01 degrees 19 minutes 31 seconds West 345.17 feet to a 5/8 inch iron pipe; thence North 89 degrees 05 minutes 10 seconds West 680.40 feet to a 5/8 inch iron pipe on the East right of way margin of Old Lucille Road (an 80 foot right of way); thence North 17 degrees 16 minutes 01 seconds East along the East right of way margin of Old Lucille Road 359.72 feet to the point of beginning. Said parcel being in Land Lot 174 of the 28th Land District of Early County, Georgia, and containing 5.00 acres more or less.

Said property is known as Rural Route 6 Box 40, Blakely, GA 39823, together with all fixtures and personal property attached to and constituting a part of said property, if any.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.

Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Deed.

Said property will be sold as the property of Barbara Tolbert, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Barbara Tolbert , and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
